Many years ago, when I was nothing but a ‘pup’ of sorts, I found out what freedom was (or so I thought), in my heart, soul, and mind, when I soloed my first aircraft at age 16, on a grass runway, in Anita, Iowa. Just a kid, by any sort, but I always had dreams of freedom, but when I flew that single engine Cessna 150 aircraft, into the sky on my first solo, and then subsequently set it back onto the grass runway "intact" I knew then what freedom was, or so I thought. It was an internal feeling of pride, accomplishment, and FREEDOM being all alone in that aircraft in the sky, or so I thought.
Now I am 57 years old, and my dreams are still always taking me back to freedom, but “not” that of flying "free" in the Cessna Aircraft. Now days, I have re-discovered each and every day that being "free" and having “happiness” is just simply (not thru a plane) but just plainly enjoying my dogs, pets, and animals, thru their “intrinsic value” of their lives associated as my extended family and as my own. My dogs, pets, and animals are not the governments, they belong to me, and I love them, without Uncle Sam, Aunt Nazi, or Cousin Pervert, getting in my way of "animal happiness" just to love and take care of my dogs, pets and animals on my private property.
The battle for animal owner freedom is real and fading fast.
No matter what locale a person lives in, you will find "perverts" of every kind, type, nature, nationality, age, sex, etc. and that is “not” a good thing. But each person who owns a dog, pet or animal faces only the “pervert” kind that "affects" each of our lives directly. And that “kind” affecting each of our lives is the "perverted" animal rights groups, organizations, government bodies, government entities, and/or animal controlling agencies that purposely “intrude” into our lives, for plain no damn good reason, other than taxation thru fees, fines, and animal confiscations to control all of us, thru our animals. All these controlling people in authority of some type or jurisdiction, demanding to tell you, me, and all the pet owners in their areas of responsibility how to live with my pet, what to fear about my pet, and especially what and how “FEAR” with the animal laws governed by all these above listed animal controlling authoritarians.
Never under estimate the power of one ‘rogue” animal controlling authority on your private property.
The animal complaints stem from every locale, thru out Canada, the USA, and entirely worldwide. How many times have you heard of these animal complaints on “animal cops?” The scenario is virtually always the same:
The animal rights controlled animal shelter gets a new confiscated puppy to gracefully make their own thru your failure to meet their fees, fines, and penalties involved in their confiscation of your pets, making a fast buck thru donation for re-adoption of your confiscated pet.
In summary, this mass government sponsored “humane society” which I refer to as an alleged puppy “mill” “theft” for rescue, adoption, or pet murderer thru ‘forced’ animal law enforced “dangerous dog” designation euthanasia programs, written into these animal laws, to enforce many simple yet non-offensive or non-harming animal care and control regulations, start examples of the above animal controlling processes by you simply not noticing that 5 minutes ago (or there about) you as the pet owner allegedly left an empty pet bowl without water in it.
Subsequently at the end of all the legal proceedings in the animal controlling incident, the government sponsored animal controlling authorities (allegedly called humane societies) which are, in fact, a business of keeping and selling “your” pets and animals of sorts, make an alleged profit (sorry adoption fee, pull fee or donation fee) from the dogs, cats, pets and animals they adopt out (as a rescued animal) from you, the pet owner described above (as just one example).
NOW, THAT IS WHAT HAPPINESS IS ALL ABOUT!
All you wanted to do was have that same ole feeling of “freedom” and “happiness” with your pets and animals on your own private property as We as People recognizes as a “freedom” not a rule of animal law.
Just like when I “thought” I was free when I was 16 years old, flying solo in that Cessna 150 aircraft, I now know that my thoughts of being “free” now are “not” of just about me personally, or my pride or physical accomplishments, like soloing in a plane, but that “freedom” and “happiness” come from a more major “intrinsic” value in my life. Which is just a damn silly little puppy, dog, cat, or other pet or animal in my home that I can call my extended family; now that is “freedom” and “happiness”. For my pets and animals belong to “me” not the government, Period. And no “stroke of the pen” in animal care and control laws can change that fact. “My dogs, pets and animals, belong to “ME”!
Have you ever said to yourself or anyone else, essentially that you have lived your life the way you wanted to, that you have done everything you ever wanted to do in life, and did it all well? Now that We as People become older in the circle of life, we as people only want the same thrill of the past “freedoms” and “happiness” but it can truly only now be found in the “intrinsic value” of an animal’s life. If you love pets and animals, that is...
Let us each just recognize and pleasantly say to ourselves and others that owning a simple little puppy, dog, cat, horse, or other pet animal, or even two or three, four or more animals on private property, whatever … that you as a pet owner can responsibly take care of them, and it is not morally, legally, or simply “animal hoarding” by a "perverted" animal law definition. Rather, it is called being responsible for your own extended family, children, pets and animals recognizing that “We as People” are never perfect in all that we do in life. Even God and Jesus Christ recognize this fact in life, yet animal control authorities and animal care and control laws do not honor or obey. They just exercise the letter of the laws, and easily inflict “tyranny” thru these animal care and control laws everywhere, in the name of the law (called Man’s law, not God’s).
We the People of all careers and those dealing with authority over people and their animals, need to remember from time to time, that pet owners are only human, and not a robot, or superman or superwoman, and on occasion may make mistakes, even with a simple little puppy. No one gets killed, maimed, arms, legs or paws cut off, no one gets there ass shot, starved, tortured, mutilated, or stomped on... not even their puppy or other animal in their care, just because the animal laws, state a violation may have occurred by strict “definition” of the animal laws in question in your area or jurisdiction of your private property.
The “formula” now used to describe animal care and control.
Animal Rights + Perverts + Nosey Neighbors + Animal Legislation Lobby Money + Activist or Animal Hating Groups that Don't appreciate Freedom Fighters + Animal Rights Agendas + Hungry Money Seeking Reelection Funds for Legislators = YOUR SOON TO BE CONFISCATED, SEIZED AND SOON TO BE ADOPTED OUT OR EUTHANIZED PUPPY, DOG, CAT, PET OR ANIMAL MAYBE ADOPTED OUT (LEGALLY STOLEN) OR SEIZED FROM YOU, simply just because of a “minor” and “harmless” animal law infraction for example just for not noticing in 5 minutes, that alleged empty bowl of water for your pet or animal, before the “activist” or busy body neighbor reports it to animal control authorities.
Now days the story never ends all around the globe with pets.
An end of “freedom” and “happiness” is the TYRANNY imposed by Man’s law, upon God’s pet owners and animals. HAPPINESS FOR YOU AND NOW YOUR LITTLE PET OR ANIMAL, (LIKE A PUPPY) WILL NOW SOON BE GONE FOREVER! By the stroke of an “animal rights” legislators or animal control authorities pen.
Maybe Tomorrow Will Bring a Better Day!
For you, me, and all the people in this world, who own, love, and care for their pets and animals. Or “May-Be Not”!
Does ANYONE even Care? Or appreciate the simple heart-felt love for a pet “companion” animal and still have a desire to retain their FREEDOM?
We as pet owners are growing tired of “tyranny” upon our lives and our pets and animals, mainly in the name of “taxation without representation” (animal license taxes) let alone the multitude of animal care and control laws growing by leaps and bounds every single day in all locales worldwide. So, I think we should all just stop here, go to bed, WITH YOUR PETS, and before we lay our heads on the pillow look at our pets next to each of us, and thank God and Jesus Christ, for just one more day of “freedom” and “happiness” with our puppies, dogs, pets or animals, and happily just go to sleep with our little and alive precious "fur-balls" lying against our face!
NOW THAT's HAPPINESS! Just like being solo in a Cessna aircraft having the “freedom” and “happiness” in our life style! God please bless our “freedom” and most of all “bless” our pets and animals. In the name of Jesus Christ, AMEN!

The “WORD” of the Bible in many forms, contains various descriptive uses of the term “Dog” but in reality of our Lord and God, the true meaning and existence of a “Dog” has been taken out of context by religion, churches, or even in the descriptions in the Bible. In order to begin an accurate discussion on this topic, we must first examine what descriptions of the term “Dog” are actually in the Bible. I provide many of these Bible descriptions in excerpts as follows:
“Dog” references in the Bible
The watch of the house, and of the flock (Isaiah 56:10-11; Job 30:1) … which fall from their master's table." More commonly owner-less, and banded in troops which divide cities into so many quarters; each half-starved, ravenous troop keeps to its own quarter, and drives off any intruder; feeding on blood, dead bodies, and offal; therefore regarded as "unclean" (1 Kings 14:11; 1 Kings 16:4; 1 Kings 21:19; 1 Kings 21:23; 1 Kings 22:38; 2 Kings 9:10; 2 Kings 9:35-36)
Their dismal howling at night are alluded to in Psalm 59:6; Psalm 59:14-15; "they return at evening, they make a noise like a dog, and go round about the city"; perhaps in allusion to Saul's agents thirsting for David's blood coming to Michal's house at evening, and to the retribution on Saul in kind, when he who had made David a wanderer himself wandered about seeking vainly for help against the Philistines, and went at last by night to the witch of Endor. As unclean (Isaiah 66:3) … dog, dead dog, dog's head, are terms of scorn or else self-abasement (1 Samuel 24:14; 2 Samuel 3:8; 2 Samuel 9:8; 2 Samuel 16:9; 2 Kings 8:13)
A wanton, self-prostituting man is called a "dog" (Deuteronomy 23:18)
One Egyptian god had a dog form. "Beware of the (Greek) dogs," those impure persons of whom I told you often" (Philemon 3:2; Philemon 3:18-19)
…dogs in filthiness, snarling, and ferocity against the Lord and His people (Psalm 22:16; Psalm 22:20)
… Backsliding into former carnality, as the dog "is turned to his own vomit again" (2 Peter 2:22)
The Jews regarded the Gentiles as "dogs," but by unbelief they ceased to be the true Israel and themselves became dogs (Isaiah 56:10-11) "Deliver my darling from the power of the dog."
Not only are there many references or descriptions to the term “Dog” in the Bible, but in many other faiths and their writings as well all over the globe, to include African Mythology as follows:
"Juok and the Dog That Preserved Mankind (Anuak/Sudan)". Juok (Jwok), the creator, the Supreme Being, was an androgynous god, an all-powerful and omniscient spirit. He had sons—first an elephant; then a buffalo, a lion, a crocodile; after that, a little dog; and, finally, man and woman. When he saw the humans, beings without hair, Juok told the dog to throw them away. The dog took the humans to a tree, and put the children into a hole in that tree. Then, without his knowledge, the dog milked a cow from among God's herds and fed the children. The children grew up, got too big for the tree, so the dog took them to the country, where they built a house. They became a man and a woman. (Excerpt from: A Dictionary of African Mythology, Author, Harold Scheub)
Could this be where the term, “DOG” can be spelling reversed into the meaning of “GOD”?
DOG vs. GOD in reverse spelling
The spelling reversal of the term “DOG” into meaning “GOD” has been a sore spot among Christians, Islam, Muslims, and other religions or faiths for a very long time. I have seen many of the weary skeptics who thought the healing of humans thru a personal interaction with a dog was just a “dog and pony” show to draw people into a group or even a church. I have found since, there is some truth in my skepticism, but like anything else, one bad apple doesn’t mean that the rest of them are bad - unless it is left unattended to, then it will eventually spread rot throughout the entire basket of life. Jesus warned us about such teachings -- He used yeast as His example, how it takes such a little amount to work its way through the dough making it impure (Lk 12:1-3 & Matt 16:12).
My contention and message here is that there are many types of "Dog Value Doubters" and “Dog Haters” in this world, and even in many religions and faiths who claim to be of God. An example of this wrongful “hatred” of dogs can easily be found in Islam, Muslims, and many Animal Rights groups as well.
The health and wealth messages preached but fail to speak about the dogs
By some, these above groups or religions have left a bad image toward something God has intended as a great and wonderful gift - THE DOG. To some, whenever the words faith and healing are said in the same sentence as a dog, it is usually dismissed as one of those tongue talking health and wealth or animal fanatics.
Having been raised in a conservative church, I am aware that there is not much tolerance for any type of "healing" except that of their “WORD” of the Church you attend, and their “WORD” rarely if ever includes the extended family of humans, called “The Dog.” The DOG is a valid source of healing one’s spirit, soul, and body thru the interaction of a dog with the human. I have visited many congregations in churches that preach health and wealth in their churches and couldn’t get past all the hype, glitter, performance, and racket, and lack of caring for any animals, and specifically the “dog” as a true "intrinsic value" to life.
The two most common beliefs that seem to rub people the wrong way, and have for many years, are the health and prosperity movements - “Health and Wealth” or “Name it and Claim it”, also known as Animal Rights movements, that promote “vegetarianism” and the “hatred” for humans to freely own pets and maintain animals in their care and control. These Animal Rights and animal hater religious or political movements have become primary reasons why so many religious believers are cautious about even the thought of healing outside of a physician’s care, let alone the healing power of the love and caring for an innocent animal like the dog.
What a shame to discount the dog's power to heal, regardless of the means of healing it is still God who does the healing and he does so thru the power of the innocence, interaction, and love in the “dog”. At one end of the spectrum there are those who do not believe in physicians, hospitals, or medicine, or animal healing, etc. At the other end are those who put all their faith solely in physicians, hospitals, medicine, etc., yet still none in the dog. Yet they both still do not look to healing their bodies, spirits and souls thru companionship with a good and loving dog as a healing therapy.
It may be God’s will for us to go through an illness or a disease, if not for our own good, maybe for the good of another. We are called to be the light and salt. (Mt 5:13-14) If we spend time grumbling about being ill we may miss the purpose and the blessing God has for us. There is nothing wrong with turning to God saying, “I don’t know the purpose, nor do I like the illness, but help me understand, give me the strength and understanding to persevere in doing your will not mine.” And then each of us needs to turn to “man’s best friend” for the healing power of the dog.
We shouldn’t try to under estimate God’s purpose for our lives, if we think shallow, shallow is where we’ll stay, and if we think only of ourselves, selfishness is a lonely place. But when we are lacking in our ability to control our lives, either because of monetary, health, or wellness issues, we need to start the “healing” process by turning our selfishness for “serving our own needs and wants” to serving our Lord and Master, by turning our attentions to our dogs as their Master in the humble image of God-like tendencies and behavior, Faith, Love, and Charity, or if you don’t have a dog, then turn your attention to helping other dogs in need in order for you to receive their healing power. This is the path to true healing power of God, thru a Dog.
Healing is not a "dog and pony" show -- it is real. It comes in different ways and at different times, but we must not limit God because of someone else’s overzealous flamboyant ways "putting down" the dogs. God desires to heal us. We should not let other religions, “Animal Rights”, or perverted” Animal Laws and religions or their agendas to stifle our personal healing thru the unselfish love, care, and control of our ownership of a dog.
Canine comfort that has healing power is my religion
Canine comforts, known in the mental health profession as “therapets,” are providing "wordless" warmth, a brief respite for emotionally bankrupted victims. Dogs do have a healing power, even more than any religion or wealth. Dogs don't ask anything of you. They don't ask you any questions; they don't give you any advice. They are just there for you." It’s very healing to the dog owner.
With the dogs in therapy either personally with your own dog or with a trained therapy dog; for a few minutes you forget your monetary troubles, mental health troubles, illnesses or disease unhealed. The dogs provide something that a preacher or religion just can't provide. The healing powers of animals (especially dogs) for troubled people have reduced levels of stress, depression, and even their heart risk. A dog owner finds needed happiness and well-being through this primal connection of caring for the dog. The reverse spelling of this "word" meets the definition: "Dog" reversed means "God" in my book. Even desperately ill patients respond to this unorthodox but legitimate therapy - a cold wet nose and a furry cuddle of a dog or a puppy means as the power to heal.
Even Cambridge, England, researchers discovered that, within a month of taking a cat or dog into their home, new owners reported a "highly significant" reduction in minor ailments.
The Baker Medical Research Institute in Melbourne, Australia, showed that the health benefits were more far-reaching still. A study of some 6000 patients revealed that those with pets had lower blood pressure, a lower cholesterol level and, as a result, a diminished risk of heart attack. And American researchers have established that, even after a heart attack, dog owners are more likely than other coronary patients to be alive a year later.
The reasons are simple, experts say. Pets (especially dogs) help us reduce our state of arousal, which reduces blood pressure. We are fulfilling our most primitive and basic need - the need to touch.
Dr Yokoyama Akimitsu, head of the psychiatric unit at Kyosai Tachikawa Hospital in Tokyo, says pets can also help us by making us feel less lonely, by creating a feeling of being needed and by encouraging social contact with others interested in animals. They are also a stimulus for healthy exercise, keep us busy and make us feel safe.
For some people, animals can provide more consistent emotional support than humans. A Warwich University, England, study found that people who are poor at confiding in others, showing love or making friends were able to lavish affection on a pet.
Whether we pamper our pets or depend on them, few of us would quarrel with the World Health Organization's pronouncement that companion creatures bring us immense benefits. But for some, this comes as a revelation.
The healing power of dogs
A famous dog quote but still very true: "There is no psychiatrist in the world like a puppy licking your face."
All pet owners know the health benefits of having pets. It's those that do not own one that still need to be convinced. For thousands of years, humans and dogs have co-existed with each other for mutual benefits. However; for humans, the medical benefits of having a dog around maybe more profound. In 1962, child psychologist Boris Levinson reported significant improvement in several of his clients when he began bringing his dog Jingles to work with him. This defined the use of the first therapy dog which was Jingles, who accidentally walked into the job due to his master, Dr. Boris Levinson. Dr. Levinson, a psychologist, noticed that he was able to reach a disturbed child when the dog, Jingles, was present.
I am sure we have "not" all heard it time and time again. Having a pet adds to healing power. When people first get cats, or dogs, they always love having them around, but they could not quite grasp the concept that they are good for their health and why. A dog is truly a man's best friend, in more ways than one. Not only do these furry friends provide companionship and unconditional love, by owning a dog but they also have many positive health benefits. Although most dog lovers have long professed the medical benefits of dog ownership, it has been only a few years since reputable medical associations have studied this canine/human relationship with an eye toward understanding their healing power.
The Power of Love and Companionship
Using dogs for healing, therapy, companionship, or emotional support is not a new thing in our world. But what has become new is the extent of its popularity and success rates in the United States, Canada, and the world.
What I hope to achieve by this article is to "awaken" people to the power of the “WORD” (DOG) to let each person who reads this article to finally discover the power of the healing power religion of “The Dog.” You may never look at your dog the same way again after reading this article!
Now I can finally explain why I don't go to church without my dog
"When any government, it’s laws, or any church for that matter, undertakes to say to its citizens, church members, or loyal subjects, the following “WORDS” – “This you may not read”, or “this you must not see”, or “this you are forbidden to know”, then the end result is “tyranny” and “oppression” no matter how holy the motives or good the intentions are of the government, the law, or the religion in its “execution” of its agenda to care for and control it’s people, and that of its care and control of pets and animals in society, under the perverted legal term called “humane" or "animal health.”
A man or woman who becomes a lover of dogs starts a healing process not equaled by any religion or physician, when their concerns, cares and responsibilities place the dog on the same level as their favorite cherished property or item within their home. My Meaning is that he/she will search high and low for that special property that has been lost or misplaced. But with a dog, there is even more of a spiritual, and now a legal bond more than just a piece of property. A Dog now has a personal, judicial and legal “Intrinsic Value” and can no longer be considered just a piece of meaningless property like “Chattel.”
Once a dog lover always a dog lover, no matter whether the circumstances of his/her “after” life compel him/her to love them from afar. The dog is the better for it and so are the man or the woman, and even the child. My advice is to “buy your son or daughter, or yourself a dog”.
The dog's "Intrinsic Value" to your lives, cannot be overstated.
The “Dog” isn’t the bad guy for being referred to in reverse spelling as “God”- People are.
In summary, regarding my “religion of the dog” statements, I say: Preserve
common sense” in your "Kindness" to all owner's animals, and kindness for each other in society by not 'over-reacting' to dog attacks being promoted in “propaganda” media attacks to obtain 'bad' animal care and control legislation. It's that simple. It will make the world a better place for each of us if we only give our dog's love, teach them kindness for each of us and each other, and give kindness to all animals, with a chance to thrive in preserving dog and pet "Intrinsic Value" in ownership with lawful freedom on our own private property with responsibility. And we need to allow the newly defined “religion of the dog” to take hold in your own home to begin the healing process. God bless our dogs, and their power to heal our troubles and pain.
I Say: “A man's religion is not worth its salt, if his dogs are not the better for it.” AMEN!

Laws are only words written on paper, words that change on society's whim and are interpreted differently daily by politicians, lawyers, judges, and policemen. Anyone who believes that all laws should always be obeyed would have made a fine slave catcher. Anyone who believes that all laws are applied equally, despite race, religion, or economic status, is a fool. We cannot, by total reliance on law, escape the duty to judge right and wrong. There are good laws and regulations, and there are occasionally bad laws or regulations, and it conforms to the highest traditions of a free society to offer resistance to "bad" laws or regulations, and to "disobey" them. Am I not destroying my enemies when I make friends of them, using God's word of power and authority? Never undertake anything for which you wouldn't have the courage to ask the blessings of heaven. When Police or Animal Control Come Knocking On Your Door; What Every Dog Owner Needs to Know

Dog owners and ethical breeders are increasingly being targeted. Disgruntled neighbors may retaliate against dog owners and may other reasons drive complaints, and anti-dog enforcement action, which many times may be conducted illegally.
The following text outlines methods of inquiry and enforcement which may be used by local officials in attempts to enforce ordinances in your community and suggested techniques of response. These techniques are entirely legal and based upon the rights of citizens as stated by the U.S. Constitution.
No breeder wants to have Animal Control come knocking on the door...but if they do, it will help if you know what your options are.
Remember, Animal Control is law enforcement. They are bound by the same Constitution as any other government agency. To protect yourself, you need to know your rights. These vary slightly one jurisdiction to another, but some general principles apply. One rule applies everywhere: never physically resist an officer.
When Animal Control is At Your Door:
Do not let them in, no matter how much they ask. Animal Control generally cannot enter your home without a warrant, or your permission. While regular police can enter in emergency situations when human life is at risk (i.e. they hear gunshots and a scream inside), there are few, if any, situations in which Animal Control can enter your home without a warrant. Simply tell them they may not come in.
- If you let them in, anything they find in "plain sight" can be used against you. In some circumstances Animal Control officers, unable to find a legitimate reason to make an arrest, have reported building or zoning violations. This may include caging you attached to a wall without a building permit, that extra outlet in the puppy room, having more pets than allowed by zoning, even extension cords in violation of fire codes! No matter how clean your kennel, if they want to find a violation, they will.
- Do not talk to them from an open doorway. Step outside and close (and lock if possible) the door behind you. This is necessary because:
- A) Anything they see through the open door is "plain sight" and may be the basis for an arrest, or probable cause for a search warrant.
- B) If they make an arrest or even feel threatened they are usually permitted to search for weapons in your immediate area. Do you keep a baseball bat inside the door for your protection? Even if you don't, once they step inside to look, they are in your home and may continue to search.
- C) It is hard not to be intimidated by someone in authority. Some animal control is even done by local police, who carry guns. It is easy for them to get "in your face", causing you to back up into the home. Once you go in, it will be interpreted as an invitation to follow.
- - If they claim to have a warrant, demand to see it. In general, a search warrant must be signed by a judge. A warrant to search your home for dogs does not include an inventory of your jewellery box. A warrant to search your kennel in the garage or in the barn does not include a search of your home.
- - In some locations dog owners may have obtained special "breeder permits" that stipulate that Animal Control has your permission to enter at any time. If you have signed such a permit they still cannot enter against your wishes, since you can revoke the permission at any time. However, if you refuse permission it may allow them to cancel your breeder permit, so you have to weigh the consequences.
- - Warning - anyone in lawful possession of the premises may be able to give permission for a search. Make sure your roommate, babysitter, dog-sitter, housekeeper and other know that they should not let animal control into your home or on your property (i.e. backyard, garage, etc.).
How to Handle Questions:
Don't answer any questions beyond identifying yourself for the officer. Anything you say to the officer in your defence cannot be used in court (hearsay). Anything you say that is harmful to you will be used in court (confessions are not considered hearsay). You cannot win, except by remaining silent.
- Be polite but firm. Do not argue, bad-mouth, curse, threaten or try to intimidate the officer.
- Do not lie to an officer, ever. However, it is NOT a lie to exercise your right to remain silent.
- Keep your hands in plain sight. People have been shot by police when common objects, such as a wallet, were mistaken for a gun.
- Do not touch the officer in any way. Do not physically resist an officer, no matter how unlawful his or her actions.
- Don't try to tell your side of the story, it cannot help.
- Do not threaten the officer that you plan to file a complaint for their actions.
- If the questioning persists, demand to speak to a lawyer first. Repeat as necessary.
Gathering the Facts:
Get the name and badge number of each officer involved. If he/she does not volunteer this information, ask.
- Ask the name of the agency they represent. Different agencies have different enforcement responsibilities.
- Ask why they are there. Request the factual basis of the complaint and the identity of the complainant.
- If they have other people with them (Humane Society, press, etc.) get the names and organizations for all present.
- Note the names (and addresses) of any witnesses to the encounter.
- If you are physically injured by an officer, you should take photographs of the injuries immediately, but do not forego proper medical treatment first.
- Write down all of the information, as well as the date and time of the incident immediately, while details are fresh in your mind.
- If you rights are violated, file a complaint with the appropriate body.
If You Are Arrested:
Remain silent. Answer no questions until you have consulted with a lawyer.
- Don't "explain" anything. You will have time for explanations after you have talked to a lawyer.
- Within a reasonable time they must allow you to make a phone call to get a lawyer or arrange bail. They are not allowed to listen to your phone call to your attorney, but they may "monitor" the rooms for "your protection". Do not say anything you do not want them to overhear; save that until after you are out on bail.
Telephone Inquiries or Threats:
You may receive telephone inquiries concerning the number of dogs you own and whether any dogs or puppies are for sale. Other questions may also be asked.
Your response should be to inquire "Are you interested in a puppy?". If the answer is "yes", ask that person for his/her name, address and phone number. Suggest that you or a responsible breeder will contact that person at a more convenient time for you.
If the answer is friendly and genuinely inquisitive, invite the person to look at your puppies.
If the question asked is "What is the price of each puppy?", simply say that puppies of this type are being sold for between "X" and "Y" dollars. Never say that you are selling them.
If the question asked is "Are these your puppies?", you should ask, "Why do you want to know?".
If you conversation indicates that the person is representing the county clerk's office or allegedly representing an official body, ask the caller for:
Full name, title and phone number
Agency's full name and full address
Their supervisor's full name and phone number
Nature of the inquiry (what it is about)
Why the inquiry is being made
How your name and phone number were obtained
Ask that all future questions from that agency be submitted in writing
Preventative Measures:
Always keep you kennel clean and take good care of your animals.
- Consider a P.O. Box or other address for business cards and advertisements. Keep descriptions of your location general (i.e. Southern California, rather than the name of the city where you live). The internet can provide anonymity for initial contacts. You can even buy a "remote prefix" to get a number from a nearby community forwarded to your phone or to a voice mail. Avoid local newspaper classifieds, they are often monitored.
- Screen any potential puppy buyers carefully. Always be alert that they may be Animal Control or even Animal Rights working under cover.
- Don't allow strangers into your home until you have screened them.
- Be fair and honest in all of your dealings, and be on good terms with your neighbors. Most animal control contacts are complaint-driven. Some complaints may arise as harassment by people with unrelated grievances against you. It may be a disgruntled dog buyer or a cranky neighbor who doesn't like you parking in front of his house.
- Anything about you that can be observed in "plain sight" from the street or sidewalk can become probably cause for a warrant. Even areas on your property open to visitors can be dangerous. Be aware of which areas of your home are visible from the outside and plan accordingly.
- If you are confronted by Animal Control and turn them away, assume they will be back. Use the time available to make sure everything is clean and presentable. If you are over the limit on the number of pets, find friends who can provide temporary shelter for your dogs.
- Whatever you do, stay calm and keep your wits about you.
- Just say "no", no matter what threats or promises of leniency they make.
- When in doubt, say nothing and speak to a lawyer afterwards.

How Does Due Process Apply
to Dog Seizure/Euthanasia Cases?
Despite the fact that animals are still considered
property in all legal jurisdictions today, due process, whether rooted in the
federal or state constitutions, extends to life, liberty, or property. The more
complicated issue, however, is how much process is
due?
The Supreme Court has promulgated a four prong
test to determine this. In each situation, a court must
weigh:
-the private
interest affected by the official action
-the risk of an erroneous deprivation of that interest
through the procedures used,
-the
probable value of additional procedural safeguards, and
-the government interest
involved.
Mathews v. Eldridge,
424 U.S. 319, 335 (1976).
Does Due process requires
the opportunity to be heard at a meaningful time and in a meaningful
manner?
Rabon v. City
of Seattle (Rabon II), 107 Wash.App. 734, 743 (2001) (citing Mathews,
424 U.S. at 333). Thus, when individuals can show they will suffer irreparable
harm from a post-deprivation hearing, courts has recognized that a
pre-deprivation hearing is necessary. In the case of orders to euthanize pets,
many courts have considered the loss to the pet owner as
irreparable.
Before any court hearing can dog owners file a
Petition for a Preliminary Injunction?
Dog owners should file a petition for an injunction to
delay the killing of the dog until they have had the chance to be heard in court
(For an actual example, see Petition for Preliminary and Permanent Injunction in
the case of Wilson v. City of St. Louis (1990), which involved a Pit Bull named
"Max" who was impounded and classified as dangerous because he allegedly killed
the neighbor’s dog. The Circuit Court found that the plaintiff would suffer
irreparable harm if the preliminary injunction was not granted and enjoined the
city from killing or otherwise harming Max. The court ordered the city to
release Max and change his dangerous designation to potentially
dangerous.)
Is there any
way of overriding a bad decision by a petition for a writ of
Mandamus?
Due process
includes more than just going through the motions of a hearing. In fact, even
after hearings have been granted, decisions can be challenged as a prejudicial
abuse of discretion that is not based on findings of fact or law. (This is what
the owners of Boo, a bull mastiff who allegedly bit a child, argued in Williams
v. Orange County Animal Control (1996)). In this case, owners should file a
Petition for a Writ of Mandamus, a judicial remedy issued by a superior court to
compel a government officer to do or forbear from doing a specific act, to delay
the euthanasia order until the appeal can be heard. This writ of mandamus
applies in any situation in which the euthanasia should be stayed, including
scenarios in which an original hearing was never given.
What are the minimum standards of Due Process
for a hearing for dog owners?
It is now also clear that hearings must meet certain
minimum standards. Informal reviews that animal control agencies frequently
provide upon the dog owners request often do not fulfill these requirements,
because the decision-maker may not be qualified to render the judgment or may
not be impartial if he also made the original decision to euthanize the dog. For
example, in Phillips v San Luis Obispo County Dept., 228 Cal.Rptr. 101 Cal.App.
(2 Dist., 1986), the owners of Missy, a black lab known to have a bad habit of
biting children, contested the city’s decision to euthanize her. The amicus
brief filed by Joyce Tischler of the Animal Legal Defense Fund pointed out the
Municipal Codes at issue did not provide for the Animal Regulation Directors
orders to be reviewed by the Chief Sanitarian of the County Health Department or
the supervising environmental health officer, the two individuals who presided
over the first and second hearings.
Are there any challenges to
the animal ordinance itself?
In fact, many city ordinances are flawed in that they
fail to specify that owners are entitled to hearings before their pets are
euthanized. These municipal codes can be challenged as unconstitutional and,
even if the city already granted hearings that met minimum due process
standards, the decision to euthanize the pet would still have to be overturned.
Otherwise, whether dog owners generally would receive due process would be at
the whim of the animal control agency, and the city could avoid having to
correct its municipal codes simply by voluntarily giving all dog owners a
hearing. The court of appeals in Missy's case agreed, concluding that the
ordinances here are unconstitutional for failure to provide for notice and a
hearing either before or after the seizure of an uncontrollable biting or
vicious dog.
Most recently, in a
landmark case, the court of appeals in Mansour v. King County, 128 P.3d 1241
(Wash.App. Div. 1, 2006) held that due process required even more than offering
owners a hearing, ordering that an agency seeking to enforce a removal order
must prove both the violation and the remedy it has imposed by a preponderance
of the evidence. This is the same standard of proof imposed on the government
when it attempts to temporarily remove a child from the custody of his parents.
By instituting a burden of proof on the city, the court was essentially finding
that the dog must be presumed innocent until the city can prove otherwise.
Previously, there had been no standard of proof, and reviewing courts would only
look to see if Animal Control had acted arbitrarily or capriciously. Thus, even
the most minimal evidence that a dog should be removed would suffice, and owners
would bear the burden of proving their pets innocent. Moreover, the court found
that due process attached not only for orders to euthanize an animal, but also
for orders of removal outside the county (Peter Mansour had been ordered to
remove his dog from the county or turn his dog over to the city to be euthanized
after his dog was accused of killing a cat).
Finally, the court held that due process required
Mansour to have the ability to subpoena records and witnesses in his defense,
and that the Notice and Order of Violation had to specify exactly what code
provisions had been violated. Merely issuing a brief and concise description of
the conditions for finding the violation is insufficient. Mansour was entitled
to know ahead of time exactly what the County needed to prove at the Board
hearing. If in fact it could not prove that Maxine violated a code provision
that supported the removal order, he [Mansour] was entitled to know that in time
to move for a dismissal at the Board level. Source Reference: Animal Legal and

Are there some significant problems with animal
care, control, and dangerous dog laws and euthanasia execution
solutions?
1. They do not
reduce the number of neglect, abuse, or dog bite incidents that are legitimate
in law. By focusing on the after-effects of the animal complaint of alleged
neglect, abuse or a dog bite, these laws do not take any measures to prevent
future neglect, abuse, animal care, pet owner control, or prevent dog bites. In
theory, the risk of animal care and control ordinance punishment is for a
motivation to change behavior. But most dog owners do not believe their dogs to
be dangerous or the owners to be abusive or neglectful. So the perception is
that these animal care and control laws are for 'other' dogs, problem dogs, but
not their dog. Then, when a dog complaint, incident or dog bite allegedly
occurs, that particular dog owner may face additional liability, but his/her
friends and neighbors will not change their habits regarding their own dogs.
These animal care and control laws 'do not' work as a viable
solution.
2. The animal laws do not
take into account the severity of the incident. Most animal care, control and
dangerous dog laws cover a huge range of behavior from "threatening displays" to
actual bites to simple care, and control of the dog(s). What this means is that
you may be as liable for your goofy social dog rushing out the door and charging
gleefully at a neighbor as another owner is for an under socialized, aggressive
dog who bites a child on the face. Are these equal? Under many dangerous dog
laws, they are. Additionally, animal care and control laws are intentionally
'vague' and 'interpretive' by animal control authorities. Thus the facts of
alleged animal care and control, is rarely 'pure' and never 'simple.' And may
not even be factually the 'truth' except by a personal (opinion)
'interpretation' of the animal control authority.
What does a lack of “due process” for dog owners
come down to?
Dangerous dog laws, and animal care and control laws are
a feel-good attempt to show the community that that authorities are taking
action, even with a simple animal care or control complaint or a dog bite
incident.
Unfortunately these animal
laws do not provide any protective effects to change animal - owner behavior,
merely punishment after the fact. There are many things that a community can do
to prevent dog bites, animal neglect, animal abuse, or other care and control
issues, including educating dog owners, parents, rural families or farmers, and
citizens how to supervise and when to intervene in kid-and-dog, or dog-and-dog,
interactions, teaching dog owners how to socialize and train their dogs with
methods that encourage friendly behavior and providing some basic animal
education about canine body language so the many misunderstandings we have with
dogs each day can be reduced in their care and control
issues.
Dog owners need to learn
how to defend their dogs from ‘rogue’ Animal Control Authorities before they are
confiscated, seized, and euthanized before you (as the dog owner) can obtain
Legal Counsel.
More questions and answers we need to ask about “Due Process”.
DUE PROCESS is what is missing from the ordinance of animal laws, which are in force in most jurisdictions today.
1. IF YOU ARE FACED WITH CONFISCATION OR EUTHANASIA ISSUES CURRENTLY OR BEFORE.
It is necessary that you seek counsel from an attorney BEFORE you allow any authority to confiscate your dogs, pets, or animals, and ask the attorney to intervene with authorities to stop the process, based on a review of their animal laws being used, that DO NOT contain DUE PROCESS for the pet owners according to law case precedent established in this article and case law. In this way it is very likely the confiscation can be stopped or overturned, based on an unconstitutional law.
2. HOW OT ESTABLISH "DUE PROCESS" WHEN NOT IN A PRESENT DOG CONFISCATION CASE.
It is necessary to make enough flack or waves, thru getting the word out to your local animal control legislators for the jurisdiction you are in, to make them see the light, that current animal control laws and ordinances are UNCONSTITUTIONAL, as they DO NOT contain the lawful DUE PROCESS established by these case precedents in this article containing the case law establishing the requirements for DUE PROCESS before confiscation or euthanasia. It will take aggressive campaigning and raising the flag to the locals to get a campaign going for animal control law reform in your local town, county, and state. But this needs to be done, to change the law to protect the pet owners from the current level of tyranny without law controls on THEM.
3. MOST NEEDED, BUT COSTLY TO THE POCKET BOOK.
The fastest and most public attention gathering method to change the animal laws to include the DUE PROCESS in this article is to have an attorney file a lawsuit against the jurisdiction, CHALLENGING THE CONSTITUTIONALITY of the animal law currently in force. When you establish thru evidence of the LACK OF DUE PROCESS IN THEIR ANIMAL LAWS, in court in a law suit, the Judge will have no alternative but to OVERTURN the current animal law, and it will be thrown out (the law will be) like the dish water for being Unconstitutional and vague. Thus the animal law is nullified, and no longer in force, at that moment, and the legislators will have to START OVER in creating a new animal law, that INCLUDES the ruling of a need for Constitutional DUE PROCESS included in the local animal law.
4. It is not as simple as just telling an animal control authority, that there is no Due Process.
Animal Control like cops will do ANYTHING they DAMN WELL PLEASED to you, UNTIL, and UNLESS, you OBTAIN AN ATTORNEY, to establish legal precedents to stop them. It ALWAYS comes down to working thru an attorney, BEFORE the pets or animals are confiscated or euthanized. The word needs to spread, that people, need top have A PLAN OF ACTION, and ATTORNEY AT HAND, BEFORE they are ever faced with Animal Control, in order to stop them from tyranny. If Animal Control, knocks on your door, and you refuse them entry. You have only the amount of time, it takes for them to obtain a search and seizure warrant from a judge, and their time to come back to you, in order for YOU TO GET AN ATTORNEY AND START THIS NEGOTIATION PROCESS OD DUE PROCESS, if your animal laws do NOT contain the Proper Due Process in the current Animal Laws (which almost every Animal Law in the nation does NOT have).
5. This is what must be done, by every citizen with a pet, to get DUE PROCESS in their jurisdiction.
First off, GET AN ATTORNEY, to represent you, in each case listed above. Preferably an Attorney at Law WITH some experience in Animal Law.

The newest controversy over exports from China has caused nightmares for researchers documenting the abuse inflicted on animals bred and raised in tiny cages and then skinned alive for their fur.
WND has reported multiple times on problems with exports from China, with poison found in pajamas,consumers warned against using ginger, an alert about the dangers from China's pickled vegetables and even the dangers from honey and fireworks.
Now comes word from an extended investigation into the fur trade that China is estimated to produce approximately 85 percent of the world's fur products – and it has virtually no regulations or rules for the treatment of the animals.
According to Mark Rissi, a spokesman for Swiss Animal Protection, which has documented abuse of animals raised for their fur as early as 1983, the China project has been going on for several years.
The organization's report has been made available online, with dramatic images and descriptions that researchers found more than disturbing.
"As animals are considered objects in China, there is little or no awareness for the suffering of these sentient beings," Rissi told WND from his European base of operations via e-mail. "The cruelty found was beyond our expectations, and it was hard to document without interfering. It caused nightmares to the team, especially in the editing room, because the scenes had to be replayed and replayed to be edited from six hours down to 20 minutes."
Rissi said the actual onsite investigation was done by his organization's staff members as well as trusted Asian animal protection supporters, but as fur production was not a controversial subject, "people willingly showed their farms to the team."
He said he's glad other organizations, such as the U.S.-based People for the Ethical Treatment of Animals, have joined in his group's campaign.

"Our main goal was to get this distributed because we want consumers worldwide to be aware about the cruelty involved in the fur fashion," he said.
"People have a right to know that a huge percentage of fur is imported from China, which doesn't have any federal laws protecting animals on fur farms. People who might contribute to this atrocity by purchasing fur or fur-trimmed garments need to know about the horrible suffering of the animals who wore that skin first," PETA spokeswoman Melissa Karpel told WND.
"We want them to see how fur farmers slam terrified animals — including raccoon pups — on the ground and skin them while they're still conscious. People need to know what they're really buying when they buy fur or fur trim," she said.
"Conditions on Chinese fur farms make a mockery of the most elementary animal welfare standards," the Swiss report said. "This report shows that China's colossal fur industry routinely subjects animals to housing, husbandry, transport and slaughter practices that are unacceptable from a veterinary, animal welfare and moral point of view."

The report contained the testimony from witnesses to a dog slaughter:
Once pulled out from its cage, the raccoon dogcurls up into a ball in mid-air. … One woman in a headscarf is first to grab hold of the raccoon dog's tail and the others drift away peevishly. The woman in the headscarf swings the animal upwards. It forms an arc in the air and is then slammed heavily to the ground, throwing up a cloud of dust. The raccoon dog tries to stand up, its paws scrabbling in the grit. The wooden club in the woman's hand swings down onto its forehead. The woman picks up the animal and walks toward the other side of the road, throwing it onto a pile of other raccoon dogs. A stream of blood trickles from its muzzle, but its eyes are open and it continues to repeatedly blink, move its paws, raise its head and collapse to the ground. Beside it lies another raccoon dog. Its four limbs have been hacked off but still it continues to yelp.
The report then graphically describes how the dogs are skinned, sometimes while they are living.
Rissi noted that the Humane Society of the United States also has worked on the investigation, citing well-known U.S. companies, including J.C. Penney, Burlington Coat Factory, Bloomingdale's, Sak's Fifth Avenue and Macy's, for selling Chinese-produced fur products, sometimes labeling them as "faux fur" or raccoon when the actual product is from a raccoon dog.
The Swiss Animal Protection report said slaughter methods range from beatings with a metal or wooden stick or swinging the animal until it slams to the ground.
Then they are skinned.
"They struggle and try to fight back to the very end. Even after their skin has been stripped off breathing, heart beat, directional body and eyelid movements were evident for five to 10 minutes," the report said.

My Great Pyrenees Family Dog - Named Pringles! Rest in Peace in Eternal Life with Time for Miracles!

On 7 Sep 12, I lost my most faithful and loyal friend… My family dog, named Pringles.
Pringles was a Great Pyrenees dog. Pringles was 200 hundred pounds of pure white canine love, devotion, and doggone honest devotion to his Alpha Master, friend and owner. I loved this dog with all my heart, soul, mind and strength. A human knows not what happiness is, until you own a good dog.
Man’s world today is full of tyranny, evil, and epic proportions of untrustworthy events that speak of a coming apocalypse of national proportions. Yet, when I always went home after a day of hardship, toil, despair of the world tyranny and evil events that surround me and you in this world of today, I found it easy to put aside the world and evil doers, as soon as I saw my loyal canine friend, anxiously waiting for me, wagging his big white tail, when I drove into my country lane. At that moment, each and every day, I would thank God for my life, which was surrounded by the happiness of my dog.
I rarely speak of my personal life to the public. My life is personal and fulfilled, and belongs to me. I seek no reward, power, or publicity for my family. But I have now lost forever, my closest friend and most loyal companion in life. My family dog Pringles. If a human does not comprehend the “Intrinsic Value” of a dog, then this article and true story will have little to no impact on their lives. The point of this story is not to educate you, but to “honor” my lost canine friend and pal, and let the world know, that my dog Pringles, gave me more happiness than any human should be worthy to receive. Pringles, as my dog, never asked me questions, or made demands or power trips on me. Pringles, being a canine, is not human, and the time we spent together, was not as a human owner to canine animal. It was an Alpha dog and respectful companion animal – owner bond that only an “animal lover” with compassion, can even begin to understand.
Life is no picnic, and in the coming apocalypse of tyranny at our doorsteps, it will now be more difficult to bear, now that Pringles will not be there in my drive to greet me every day, and spend quality time with his Alpha Male master, romping and playing in the yard, sharing treats, and just knowing we loved each other each and every day.
No… it will be difficult now that my dog Pringles has gone to eternity in life. Dogs and animals do have eternal life. This I know! But as hard as it is to lose my canine friend, I recognize that God’s plan in life includes death, as part of the eternal growing plan to gain salvation. No religion, no Bible beating, No preaching to the choir, just plain and simple LOVE for a creature God made to help teach man, how to be a good human, by respecting and protecting the innocence in the animals they possess.
The healing power of our dogs
A famous dog quote but still very true: "There is no psychiatrist in the world like a puppy licking your face."
All pet owners know the health benefits of having pets. It's those that do not own one that still need to be convinced. For thousands of years, humans and dogs have co-existed with each other for mutual benefits. However; for humans, the medical benefits of having a dog around maybe more profound. In 1962, child psychologist Boris Levinson reported significant improvement in several of his clients when he began bringing his dog Jingles to work with him. The first therapy dog was Jingles, who accidentally walked into the job due to his master, Dr. Boris Levinson. Dr. Levinson, a psychologist, noticed that he was able to reach a disturbed child when Jingles was present. I am sure we have all heard it time and time again. Having a pet adds to healing power. When I first got my cats, and later, my dog, I loved having them around, but could never quite grasp the concept that they are good for my health. Dog is truly a man's best friend, in more ways than one. Not only do these furry friends provide companionship and unconditional love, owning a pet may have many positive health benefits. Although most dog lovers have long extolled the medical benefits of dog ownership, it has been only a few years since reputable medical associations have studied this canine/human relationship with an eye toward understanding their healing power. The Power of Love and Companionship using dogs for healing, therapy, companionship, or emotional support is not a new thing in our world. But what has become new is the extent of its popularity and success rates in the United States, and Canada.
What I hope to achieve by this article is the Power of the “WORD” to let each person who read this article to finally discover the power of the religion of “The Dog.”
God giving man a good dog, is truly a miracle! God bless my dog Pringles! God, my dog is now in your hands. Honor him, and take care of him, until I too, will die one fine day, and see my loyal and faithful canine friend, waiting for me at those pearly gates. But God, the happiness my dog Pringles gave me, will keep me, breathing, and keep me hoping for more miracles, to find the peace and love, my dog Pringles has given me, for so many years. When I now cry, it will not be for the “loss” of my dog, but for the “happiness” my Pringles has given to me. My dog has shown me how to be a better human.
God bless you Pringles, you, my loyal and loving dog, will never be forgotten. And one fine day, we will see each other again, in eternity…
But not yet, my Pringles… Not Yet!
In summary, regarding my “religion of the dog” statement, I say: Preserve common sense” in our "Kindness" to all owner's animals, kindness for each other in society by not 'over-reacting' to dog attacks being promoted in “propaganda” media attacks to obtain 'bad' animal care and control legislation. It's that simple. It will make the world a better place for all of us if we only give our dog's love, teach them kindness for each of us and each other, and give kindness to all animals, with a chance to thrive in preserving dog and pet ownership with freedom of property responsibility. And allow the newly defined “religion of the dog” to take hold in your own home. God bless our dogs, and their power to heal our troubles and pain.
You may never look at your dog the same way again after reading this article! That would be a miracle!

Dog Owner “due process” is not contained in current Animal Law – The Questions and Answers
Due process is ‘not’ provided to dog owners in animal control ordinances before government authorities remove or euthanize their dogs from private property.

How Does Due Process Apply to Dog Seizure/Euthanasia Cases?
Despite the fact that animals are still considered property in all legal jurisdictions today, due process, whether rooted in the federal or state constitutions, extends to life, liberty, or property. The more complicated issue, however, is how much process is due?
The Supreme Court has promulgated a four prong test to determine this. In each situation, a court must weigh:
-the private interest affected by the official action
-the risk of an erroneous deprivation of that interest through the procedures used,
-the probable value of additional procedural safeguards, and
-the government interest involved.
Mathews v. Eldridge, 424 U.S. 319, 335 (1976).
Does Due process requires the opportunity to be heard at a meaningful time and in a meaningful manner?
Rabon v. City of Seattle (Rabon II), 107 Wash.App. 734, 743 (2001) (citing Mathews, 424 U.S. at 333). Thus, when individuals can show they will suffer irreparable harm from a post-deprivation hearing, courts has recognized that a pre-deprivation hearing is necessary. In the case of orders to euthanize pets, many courts have considered the loss to the pet owner as irreparable.
Before any court hearing can dog owners file a Petition for a Preliminary Injunction?
Dog owners should file a petition for an injunction to delay the killing of the dog until they have had the chance to be heard in court (For an actual example, see Petition for Preliminary and Permanent Injunction in the case of Wilson v. City of St. Louis (1990), which involved a Pit Bull named "Max" who was impounded and classified as dangerous because he allegedly killed the neighbor’s dog. The Circuit Court found that the plaintiff would suffer irreparable harm if the preliminary injunction was not granted and enjoined the city from killing or otherwise harming Max. The court ordered the city to release Max and change his dangerous designation to potentially dangerous.)
Is there any way of overriding a bad decision by a petition for a writ of Mandamus?
Due process includes more than just going through the motions of a hearing. In fact, even after hearings have been granted, decisions can be challenged as a prejudicial abuse of discretion that is not based on findings of fact or law. (This is what the owners of Boo, a bull mastiff who allegedly bit a child, argued in Williams v. Orange County Animal Control (1996)). In this case, owners should file a Petition for a Writ of Mandamus, a judicial remedy issued by a superior court to compel a government officer to do or forbear from doing a specific act, to delay the euthanasia order until the appeal can be heard. This writ of mandamus applies in any situation in which the euthanasia should be stayed, including scenarios in which an original hearing was never given.
What are the minimum standards of Due Process for a hearing for dog owners?
It is now also clear that hearings must meet certain minimum standards. Informal reviews that animal control agencies frequently provide upon the dog owners request often do not fulfill these requirements, because the decision-maker may not be qualified to render the judgment or may not be impartial if he also made the original decision to euthanize the dog. For example, in Phillips v San Luis Obispo County Dept., 228 Cal.Rptr. 101 Cal.App. (2 Dist., 1986), the owners of Missy, a black lab known to have a bad habit of biting children, contested the city’s decision to euthanize her. The amicus brief filed by Joyce Tischler of the Animal Legal Defense Fund pointed out the Municipal Codes at issue did not provide for the Animal Regulation Directors orders to be reviewed by the Chief Sanitarian of the County Health Department or the supervising environmental health officer, the two individuals who presided over the first and second hearings.
Are there any challenges to the animal ordinance itself?
In fact, many city ordinances are flawed in that they fail to specify that owners are entitled to hearings before their pets are euthanized. These municipal codes can be challenged as unconstitutional and, even if the city already granted hearings that met minimum due process standards, the decision to euthanize the pet would still have to be overturned. Otherwise, whether dog owners generally would receive due process would be at the whim of the animal control agency, and the city could avoid having to correct its municipal codes simply by voluntarily giving all dog owners a hearing. The court of appeals in Missy's case agreed, concluding that the ordinances here are unconstitutional for failure to provide for notice and a hearing either before or after the seizure of an uncontrollable biting or vicious dog.
Most recently, in a landmark case, the court of appeals in Mansour v. King County, 128 P.3d 1241 (Wash.App. Div. 1, 2006) held that due process required even more than offering owners a hearing, ordering that an agency seeking to enforce a removal order must prove both the violation and the remedy it has imposed by a preponderance of the evidence. This is the same standard of proof imposed on the government when it attempts to temporarily remove a child from the custody of his parents. By instituting a burden of proof on the city, the court was essentially finding that the dog must be presumed innocent until the city can prove otherwise. Previously, there had been no standard of proof, and reviewing courts would only look to see if Animal Control had acted arbitrarily or capriciously. Thus, even the most minimal evidence that a dog should be removed would suffice, and owners would bear the burden of proving their pets innocent. Moreover, the court found that due process attached not only for orders to euthanize an animal, but also for orders of removal outside the county (Peter Mansour had been ordered to remove his dog from the county or turn his dog over to the city to be euthanized after his dog was accused of killing a cat).
Finally, the court held that due process required Mansour to have the ability to subpoena records and witnesses in his defense, and that the Notice and Order of Violation had to specify exactly what code provisions had been violated. Merely issuing a brief and concise description of the conditions for finding the violation is insufficient. Mansour was entitled to know ahead of time exactly what the County needed to prove at the Board hearing. If in fact it could not prove that Maxine violated a code provision that supported the removal order, he [Mansour] was entitled to know that in time to move for a dismissal at the Board level. Are there some significant problems with animal care, control, and dangerous dog laws and euthanasia execution solutions?
1. They do not reduce the number of neglect, abuse, or dog bite incidents that are legitimate in law. By focusing on the after-effects of the animal complaint of alleged neglect, abuse or a dog bite, these laws do not take any measures to prevent future neglect, abuse, animal care, pet owner control, or prevent dog bites. In theory, the risk of animal care and control ordinance punishment is for a motivation to change behavior. But most dog owners do not believe their dogs to be dangerous or the owners to be abusive or neglectful. So the perception is that these animal care and control laws are for 'other' dogs, problem dogs, but not their dog. Then, when a dog complaint, incident or dog bite allegedly occurs, that particular dog owner may face additional liability, but his/her friends and neighbors will not change their habits regarding their own dogs. These animal care and control laws 'do not' work as a viable solution.
2. The animal laws do not take into account the severity of the incident. Most animal care, control and dangerous dog laws cover a huge range of behavior from "threatening displays" to actual bites to simple care, and control of the dog(s). What this means is that you may be as liable for your goofy social dog rushing out the door and charging gleefully at a neighbor as another owner is for an under socialized, aggressive dog who bites a child on the face. Are these equal? Under many dangerous dog laws, they are. Additionally, animal care and control laws are intentionally 'vague' and 'interpretive' by animal control authorities. Thus the facts of alleged animal care and control, is rarely 'pure' and never 'simple.' And may not even be factually the 'truth' except by a personal (opinion) 'interpretation' of the animal control authority.
What does a lack of “due process” for dog owners come down to?
Dangerous dog laws, and animal care and control laws are a feel-good attempt to show the community that that authorities are taking action, even with a simple animal care or control complaint or a dog bite incident.
Unfortunately these animal laws do not provide any protective effects to change animal - owner behavior, merely punishment after the fact. There are many things that a community can do to prevent dog bites, animal neglect, animal abuse, or other care and control issues, including educating dog owners, parents, rural families or farmers, and citizens how to supervise and when to intervene in kid-and-dog, or dog-and-dog, interactions, teaching dog owners how to socialize and train their dogs with methods that encourage friendly behavior and providing some basic animal education about canine body language so the many misunderstandings we have with dogs each day can be reduced in their care and control issues.
Dog owners need to learn how to defend their dogs from ‘rogue’ Animal Control Authorities before they are confiscated, seized, and euthanized before you (as the dog owner) can obtain Legal Counsel.
More questions and answers we need to ask about “Due Process”.
DUE PROCESS is what is missing from the ordinance of animal laws, which are in force in most jurisdictions today.
1. IF YOU ARE FACED WITH CONFISCATION OR EUTHANASIA ISSUES CURRENTLY OR BEFORE.
It is necessary that you seek counsel from an attorney BEFORE you allow any authority to confiscate your dogs, pets, or animals, and ask the attorney to intervene with authorities to stop the process, based on a review of their animal laws being used, that DO NOT contain DUE PROCESS for the pet owners according to law case precedent established in this article and case law. In this way it is very likely the confiscation can be stopped or overturned, based on an unconstitutional law.
2. HOW TO ESTABLISH "DUE PROCESS" WHEN NOT IN A PRESENT DOG CONFISCATION CASE.
It is necessary to make enough flack or waves, thru getting the word out to your local animal control legislators for the jurisdiction you are in, to make them see the light, that current animal control laws and ordinances are UNCONSTITUTIONAL, as they DO NOT contain the lawful DUE PROCESS established by these case precedents in this article containing the case law establishing the requirements for DUE PROCESS before confiscation or euthanasia. It will take aggressive campaigning and raising the flag to the locals to get a campaign going for animal control law reform in your local town, county, and state. But this needs to be done, to change the law to protect the pet owners from the current level of tyranny without law controls on THEM.
3. MOST NEEDED, BUT COSTLY TO THE POCKET BOOK.
The fastest and most public attention gathering method to change the animal laws to include the DUE PROCESS in this article is to have an attorney file a lawsuit against the jurisdiction, CHALLENGING THE CONSTITUTIONALITY of the animal law currently in force. When you establish thru evidence of the LACK OF DUE PROCESS IN THEIR ANIMAL LAWS, in court in a law suit, the Judge will have no alternative but to OVERTURN the current animal law, and it will be thrown out (the law will be) like the dish water for being Unconstitutional and vague. Thus the animal law is nullified, and no longer in force, at that moment, and the legislators will have to START OVER in creating a new animal law, that INCLUDES the ruling of a need for Constitutional DUE PROCESS included in the local animal law.
4. It is not as simple as just telling an animal control authority, that there is no Due Process.
Animal Control like cops will do ANYTHING they DAMN WELL PLEASED to you, UNTIL, and UNLESS, you OBTAIN AN ATTORNEY, to establish legal precedents to stop them. It ALWAYS comes down to working thru an attorney, BEFORE the pets or animals are confiscated or euthanized. The word needs to spread, that people, need top have A PLAN OF ACTION, and ATTORNEY AT HAND, BEFORE they are ever faced with Animal Control, in order to stop them from tyranny. If Animal Control, knocks on your door, and you refuse them entry. You have only the amount of time, it takes for them to obtain a search and seizure warrant from a judge, and their time to come back to you, in order for YOU TO GET AN ATTORNEY AND START THIS NEGOTIATION PROCESS OD DUE PROCESS, if your animal laws do NOT contain the Proper Due Process in the current Animal Laws (which almost every Animal Law in the nation does NOT have).
5. This is what must be done, by every citizen with a pet, to get DUE PROCESS in their jurisdiction.
First off, GET AN ATTORNEY, to represent you, in each case listed above. Preferably an Attorney at Law WITH some experience in Animal Law.
